Indy Score for amateur indy fan movies?

I have been loosely checking out some of the fan made indy flicks on theraider.net and have a couple of question.

1. Howcome everyone can use the actual music from the movies without getting sued?

2. Where do I get these music samples if I want to make my own indy flick?

as long as the movie does not make a profit they can not be sued.
